Welcome to Baldany. Throughout this document, the words "we," "us," and "our" refer to Baldany. We run this website and the shopping experience it provides, covering all the pages, content, tools, and services made available through it (together, the "Services"). Baldany's online store is built and hosted on the Shopify platform, which gives us the technical foundation to deliver these Services to you.

This document sets out the rules that apply when you browse or buy from us. We encourage you to go through it in full, since it touches on matters such as warranty limitations and liability that affect your legal standing as a customer.

We take care to describe and photograph our products as accurately as we can, though screens differ from one device to another, so what you see may not perfectly match the item once it arrives. We can't promise that every unit will look or feel exactly as shown online. Descriptions may be updated at any point, and we retain the right to cap how much of an item can be bought or to stop selling it altogether, at our own discretion.

Placing Orders

Submitting an order through our site counts as an offer on your part to buy the item, not a guaranteed sale. We're free to accept or turn down any order for whatever reason we see fit, and nothing is final until we've sent confirmation and your payment has gone through. Take a moment to double-check your order before confirming it. If you later want to send something back or swap it, that's handled under our separate Refund Policy, and returns must be requested within 30 days of receiving your order.

Pricing and Payment

What you pay is the amount listed on your confirmation email at the moment your order goes through, though we may adjust prices on the site at any time going forward. Unless stated otherwise, posted prices include applicable taxes, shipping, or import charges. When you pay, you're responsible for giving us correct billing details and keeping them current.

Shipping and Delivery 

All delivery times are estimates and are not guaranteed. Delays caused by couriers, customs checks, or events beyond our control aren't something we can be held accountable for. Once your parcel has been successfully delivered to you, responsibility for the item passes to you.

Intellectual Property

Everything you find on the Services - logos, written copy, photos, graphics, videos, and how it's all put together - belongs to Baldany or to those who've licensed it to us, and is protected under intellectual property law. Copying, redistributing, altering, or publishing any of it elsewhere without getting our written go-ahead first isn't permitted. Any right we haven't specifically handed to you stays with us.

Third-Party Tools

From time to time we might give you access to tools built by other companies. These come with no guarantees from our side, are offered purely on an "as available" basis, and we take no responsibility for how you choose to use them.

Relationship with Shopify

Baldany is powered by Shopify. Every purchase you make is a transaction between you and Baldany directly. Shopify plays no part in that relationship and bears no responsibility for it; by shopping with us, you agree not to pursue any claim against Shopify or the companies connected to it over your dealings with us.

Privacy Policy

Whatever personal details we gather while you use our Services falls under our Privacy Policy. Going ahead and using our site means you're acknowledging that you've looked over that policy and understood it.

Your Feedback 

Should you send us reviews, suggestions, or any other kind of feedback, you're giving Baldany permission to use it however we like - reproducing it, editing it, publishing it, or sharing it - without any time limit and without owing you anything for it. By sending it, you're also confirming that it's genuinely yours to give.

Mistakes and Corrections

Occasionally the Services may contain typographical errors, pricing inaccuracies, or omissions. When that happens, we reserve the right to fix it, and, where needed, to cancel or adjust an order that was placed based on inaccurate information.

Acceptable Use

Our Services are meant for lawful purposes only. You may not use them to violate any laws, stepping on someone else's intellectual property, targeting or harming other people, spreading harmful code, harvesting personal data without permission, or otherwise disrupting the site or the people using it. Anyone found breaching these rules risks having their access cut off.

Ending Access

We're able to cut off your access to our Services whenever we choose, without prior warning. Any balance you owe at that point remains due regardless. Certain parts of these Terms relating to ownership rights, indemnification, disclaimers, and liability limits, will keep applying even after your access ends.

As far as the law allows, Baldany, along with our staff, management, partners, and representatives, won't be on the hook for indirect, incidental, punitive, or knock-on losses tied to your use of our Services or products - this covers things like lost income, lost information, or the cost of replacing something - no matter the legal theory behind the claim, and even if we'd been told such losses were possible.

Indemnification

If a claim, cost, or damage arises because you broke these Terms, broke the law, or misused our Services, you agree to indemnify and hold harmless Baldany, Shopify, and their respective affiliates, officers, employees, agents, and licensors.

Severability

Should any single part of these Terms turn out to be unenforceable or against the law, that part alone gets removed, while the rest of the document keeps working exactly as intended.

The Complete Agreement

Together with our Privacy Policy and any policies referenced herein, this Terms represent everything agreed between you and Baldany about using our Services, and it takes the place of any earlier understanding on the subject.

Which Laws Apply

Portuguese law governs this agreement, and any dispute connected to your use of our Services will be handled by the courts of Portugal.

We may revise these Terms whenever necessary, and any changes will appear on this page, with notice given wherever the law requires it. If you keep using our Services after an update goes live, that's taken as your acceptance of the new version.
